This Rental Agreement and Contract (the "Agreement") is a legally binding agreement made and entered into as of the Reservation Date written below by and between the undersigned person(s) or company (the "Guest") and the undersigned owner, manager or agent ("Rental Agent"), pursuant to which the Guest has agreed to rent the residence described below (the "Property"), for the duration of the Rental Term for the Total Rental Fee and other good and valuable consideration as described herein.
Upon booking the Property, Guest and Accompanying Guests Acknowledge and Agree to the following Terms and Conditions set herein:
Treat the Property and its content in a reasonable manner and return the Property in same condition as received. Ordinary wear and tear is accepted. Guest and accompanying Guests assume all liabilities for any personal injuries to themselves or other accompanying Guests staying with them. Rental Agent is completely exonerated and held harmless from all damages to any property or any injury to any person in or about the premises, and all costs, including attorney fees in the defense thereof, caused by the negligence or willful acts/and or illegal acts of Guest or Guest's visitors. It is the full responsibility of all Guests to maintain the Property in a clean and sanitary condition during their stay. Turn off all lights and air-conditions, and keep doors locked at all times when not in the Property. Guests are responsible to report any damage to the Property or its content to the Rental Agent. Rental Agent is not responsible for lost, stolen, or left behind personal items.
Check in time is at 3:00 pm (local time), and check out time is 11:00 am (local time). Guest agrees to depart on time and acknowledges a late check-out fee of $125. Charges will apply when departure is later than 11:00 am (local time), unless with prior agreement. We will try to accommodate.
Occupancy is defined as the number of Guests allowed on the Property at any time, not just sleeping over. Guest agrees that no more than the agreed number of Guests at time of reservation shall be permitted on the Property at any time during the Rental Term, all of whom shall comply with the conditions and restrictions imposed upon Guest under this Agreement. Guest shall use the Property for residential purpose only and in a careful manner to prevent any damage or loss to the Property and keep the Property in clean and sanitary condition at all times. Guest and any additional permitted guests shall refrain from loud noise and shall not disturb, annoy, endanger, or inconvenience neighbors, nor shall Guest use the Property for any immoral, offensive or unlawful purpose, nor violate any law or local ordinance, nor commit waste or nuisance on or about the Property.
Guest shall not assign or sublease the Property or permit the use of any portion of the Property by any other person or persons who are not included within the number of and as permitted occupants under this Agreement.
Guest agrees that all personal property, furnishings, personal affects and other items brought into the Property by Guest or their permitted guests and visitors shall be at the sole risk of Guest with regard to any theft, damage, destruction or other loss and Rental Agent shall not be responsible or liable for any reason whatsoever. Guest hereby covenants and agrees to indemnify and hold harmless Rental Agent, successors, employees and contractors from and against any costs, damages, liabilities, claims, legal fees and other actions for any damages, costs, attorney's fees incurred by Guest, permitted guests, visitors or agents, representatives or successors of Guest due to any claims relating to destruction of property or injury to persons or loss of life sustained by Guest or family and visitors of Guest in or about the Property and Guest expressly agrees to save and hold Rental Agent, successors, employees and contractors harmless in such cases.
Parents do not leave children unattended.
Pet fee of $100 per pet. Maximum of two pets permitted. Only well trained pets allowed. Pets are not to be left unattended on the Property and must be supervised at all times. Guest is fully responsible for any damages to the Property by their pet or pets.
A $200 fee for replacement of loss of keys or remotes.
ABSOLUTELY NO SMOKING permitted inside the Main home or Studio apartment. Up to a $200 fine if it is determined that someone smoked inside the main home or in the studio apartment. Smoking is permitted outside on the balconies and patio.
Guest and any additional permitted guests shall refrain from loud noise and shall not disturb, annoy, endanger, or inconvenience neighbors, nor shall Guest use the Property for any immoral, offensive or unlawful purpose, nor violate any law or local ordinance, nor commit waste or nuisance on or about the Property. A person may not make noise or use sound equipment between 9:30 p.m. and 7:00 a.m. or operate sound equipment in a vehicle audible OR produce sound audible beyond the property line of the residence. Police enforces that if you are playing loud music or making loud noise and someone can hear it 30 feet away, you are violating the law.Not adhering to the Terms and Conditions set herein automatically Terminates the Rental Agreement and Guest and Accompanying Guests are required to immediately vacate the Property and forfeit all remaining paid rent. Absolutely NO REFUNDS if any of these terms and conditions are violated. INSURANCE
Guest have the option to purchase a *Non-Refundable Property Damage Protection Plan serviced by CSA in the amount of $99, or provide a security deposit of $500 that will be refunded after customer exits the home and the Property is inspected. Refund will be in a form of a check. Refund may take up to fifteen (15) business days after guests exit the property. Refund of the Property Damage Protection Plan is refundable if reservation is cancelled within the guidelines of CSA. See CSA guidelines for refund conditions. Request refund directly from CSA.
DO NOT TAMPER WITH SECURITY SYSTEM. It is illegal to tamper or damage any or all parts of the security system. Up to $5000 fine for tampering or damaging any or all parts of the security system. They are here for your protection and your safety.
When exiting the Property on day trips, ensure that the gates are closed. Unless someone is on the Property, front gates are to remain closed.
The home is equipped with a stand-by generator. It will automatically operate during power outages. When stand-by generator is in operation, DO NOT turn on the central air-conditioning in the living room or the washer and dryer. ONLY turn on necessary lights and bedroom air-conditioning.
Most homes in Puerto Rico have septic tanks. Please do not flush toilet tissues or feminine products down the toilet.
For your convenience there are two large garbage cans in the car port area. During your stay and when you are leaving to return back to your home, please place all collected garbage bags in these cans. Property Manager will dispose all collected garbage accordingly.
For your convenience, the Property has a BBQ grill that guests are welcome to use. An additional cleaning fee of $25 must be paid to the Property Manager at time of accepting Property.
If Guest should fail to comply with the conditions and obligations of this Agreement, Guest shall surrender the Property, remove all Guest's property and belongings and leave the Property in good order and free of damage. No refund of any portion of the Total Rental Fee shall be made and if any legal action is necessary, the prevailing party shall be entitled to reimbursement from the other party for all cost incurred.
All rates are in US Dollars. All major credit cards accepted. Rates are subject to change without prior notice before reservation is made.
Deposit or full payment is due at the time of booking. Property can be reserved with half down and the remaining balance due 30 days prior to arrival. Balance must be paid or full deposit is forfeited.
Applicable 7% tax will be added to the rental quote.

There is a minimum $50 cancellation charge incurred on any cancelled reservation. Full refund minus the $50 cancellation fee with cancellations made with more than 30 days in advance. Cancellations made less than 30 days prior to arrival, forfeited all payments collected. If we are able to re-rent the Property, we will refund the Guests proportionate rent less a $100 processing fee. Minimum $50 cancellation fee is NOT in addition to any other cancellation fee, but is a minimum fee.

In the event the Property becomes unavailable for use during the Rental Term due to reasons, events or circumstances beyond the control of Rental Agent, Rental Agent shall immediately return all payments made by Guest, whereupon this Agreement be terminated and Guest and Rental Agent shall have no further obligations or liabilities in any manner pertaining to this Agreement. In the event that Guest made all payments through an Agency such as HomeAway, Flipkey, or any associated Agencies, all refunds shall be made by such Agency.
This agreement is NOT a substituted for the advice of an attorney. Not adhering to the Terms and Conditions set herein automatically Terminates the Rental Agreement and Guest and Accompanying Guests are required to immediately vacate the Property and forfeit all remaining paid rent. Absolutely NO REFUNDS if any of these terms and conditions are violated.
